New Law on the Tribunal of Conflicts, Public Utility for Railway Line, and New Rules for Tobacco Distribution

Declaration of public utility for the trans-Saharan railway project (Laghouat-Ghardaïa-El Meniaâ sections), and promulgation of a new organic law modifying the organization and functioning of the Tribunal of Conflicts. Additionally, new terms are set for granting licenses for tobacco product distribution.

1. Reorganization of the Tribunal of Conflicts

A new organic law, validated by the Constitutional Court, modifies the competencies, organization, and functioning of the Tribunal of Conflicts to align with the Constitution.
The new organic law amends and supplements the law on the competencies, organization, and functioning of the Tribunal of Conflicts. This follows a decision by the Constitutional Court which declared the law compliant with the Constitution, while issuing reservations on the wording of articles related to the appointment of judges to ensure greater legislative clarity. The new law defines the tribunal's composition, the appointment procedures for its president and members, and clarifies mechanisms for resolving jurisdiction conflicts between the ordinary and administrative judicial orders.

2. Trans-Saharan Railway: Declaration of Public Utility

Declaration of public utility for the construction of the Laghouat-Ghardaïa and Ghardaïa-El Meniaâ sections of the trans-Saharan railway line.
An executive decree declares the construction of the Laghouat-Ghardaïa (265 km) and Ghardaïa-El Meniaâ (230 km) sections of the Algiers-Tamanrasset railway line as a public utility project. This facilitates the expropriation of necessary land along the project route, covering a total area of 3019 hectares in the wilayas of Laghouat, Ghardaïa, and El Meniaâ. The project is designed for maximum speeds of 220 km/h for passenger trains and 100 km/h for freight trains.

3. New Rules for Tobacco Distribution Licensing

A Ministry of Finance order establishes new procedures and requirements for obtaining a license to distribute tobacco products.
The new ministerial order sets the conditions and procedures for granting licenses to distribute tobacco products. The order includes details of the application file, required documents, and the specifications (cahier des charges) that distributors must adhere to. These measures aim for stricter regulation of the sector, defining eligibility criteria for individuals and companies, and clarifying the obligations of licensed distributors.

4. Movements among Senior State Officials

A series of presidential decrees formalizes numerous appointments and terminations of senior officials across various ministries and government institutions.
The changes include appointments and terminations of officials at the Presidency of the Republic and the ministries of Justice, Finance, Foreign Affairs, and Energy. Notable appointments include the new President of the steering committee of the national agency for the regulation of hydrocarbon activities and Algeria's Deputy Permanent Representative to the UN in New York. The decrees also cover terminations and appointments of directors general, inspectors, and research officers.

5. Official Name Changes

A presidential decree authorizes name changes for several citizens upon their request.
The decree lists the individuals and families who have been granted authorization to change their last names upon their request. This procedure is carried out in accordance with the provisions of the civil status law, and the change is recorded in the margins of the concerned individuals' birth certificates.
