New laws on general mobilization, organization of wakfs (endowments), and beach exploitation. Maternity leave is extended, with changes to retirement age for some education staff and new training at the Higher War College.
1. General Mobilization Law
A new law establishes the regulatory framework for the general mobilization of the nation's human and material resources in case of emergency or war, defining the responsibilities of all involved parties.
The law defines the framework and conditions for declaring general mobilization by the President of the Republic to face an imminent threat. It outlines the obligations of citizens, public and private bodies, and institutions in the war effort. It specifies the roles of various ministries (Defense, Interior, Foreign Affairs...) in preparation and implementation. It establishes penalties for violating the law, such as disseminating information harmful to mobilization or evading a summons.
2. Organization and Management of Wakfs
A new law intended to update the legal framework for wakfs (endowments), strengthening their economic and social role through modern investment mechanisms while preserving their charitable nature.
Repeals the previous law 91-10. Aims to modernize the management, investment, and development mechanisms for wakfs while ensuring their protection. Defines types of wakfs (public, private, common) and confirms they are inalienable and unseizable. Opens the way for investing wakf funds through various Islamic finance formulas (Ijara, Murabaha, Istisna'a...). Establishes a general national registry for wakfs.
3. Extended Maternity Leave and Early Retirement for Educators
Significant amendments to the Social Insurance and Retirement laws, including extending maternity leave for special health cases of newborns, and providing an early retirement option for certain education sector staff.
Maternity leave is extended for working women whose newborn has a disability, congenital malformation, or serious illness requiring special care. The leave can be extended for a first period of 50 days, and a second period of up to 165 additional days based on a medical file. Certain national education staff (teachers, directors, inspectors) are allowed to request early retirement with a 3-year reduction in the legal retirement age.
4. New Rules for Tourist Exploitation of Beaches
Updating the rules for beach exploitation to ensure a balance between tourism investment and the public's right to free access, by defining and regulating the percentage of concessions.
Amends Law 03-02 on beach exploitation. The area allocated for exploitation through concession contracts cannot exceed 30% of the total beach area. Concessions are granted by adjudication. Parking or storing nautical equipment outside designated areas is prohibited.
5. New Training at the Higher War College and Sectoral Regulations
A presidential decree expands the missions of the Higher War College to include the training of civilian officials, in addition to regulatory decisions concerning the culture and public works sectors.
The decree expands the missions of the Higher War College to include high-level training for senior officers of the People's National Army and senior civilian state officials. This training awards a 'Diploma of Higher War Studies'. The internal organization of the National Higher Institute of Cinema has been defined. Positions and classifications for staff at the National Office of Maritime Signaling have been set.
